1. Introduction

These Terms of Service ("Terms") govern your access to and use of the web hosting services provided by Tork Host ("TorkHost", "we", "us" or "our") through the website torkhost.com. By creating an account, purchasing a service, or using any of our services, you agree to be bound by these Terms.

2. Definitions

• "Customer" means the person or entity that purchases or uses our Services.
• "Account" means the customer account created to access our Services and client area.
• "Content" means all files, data, text, software, images and other material stored or transmitted through the Services.
• "Client Area" means the customer portal used to manage accounts, billing and support requests.

3. Eligibility

You must be at least 18 years old, or have the legal capacity to enter into a binding agreement, to use our Services. By using the Services you confirm that you meet these requirements and that you will comply with all applicable laws and regulations.

4. Account Registration

You must provide accurate and complete information when creating an account and keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use of your account.

5. Hosting Services

We provide web hosting services as described on our website, including the features and limits set out in the plan you select. We may update plan features, limits or pricing from time to time in accordance with these Terms. The specific features of each plan are described on our pricing page at the time of purchase.

6. Customer Responsibilities

You are responsible for the Content you store or transmit through our Services and for ensuring that your use of the Services complies with these Terms, our Acceptable Use Policy and all applicable laws. You are also responsible for maintaining your own copies of important data, keeping your software and applications updated, and securing your account credentials.

7. Acceptable Use

You must use our Services in accordance with our Acceptable Use Policy, which forms part of these Terms. Prohibited activities include, among others, illegal activity, malware distribution, phishing, spam, copyright infringement and attacks against other systems. We may suspend or terminate Services for violations of the Acceptable Use Policy.

8. Resource Usage

Plans that include "unlimited" resources are subject to fair and reasonable use and the Acceptable Use Policy. We do not permit resource usage that materially interferes with the performance, stability or security of our platform or other customers' services. We may take reasonable measures to protect the platform from abusive resource usage.

9. Backups

Automatic daily backups are included with our Services as a convenience. Backups should not be relied upon as the sole copy of your data. You are responsible for maintaining your own backups of important Content. We do not guarantee that backups will be available, complete or restorable in every circumstance.

10. Migrations

Free migration assistance is included with our plans. To complete a migration, you may need to provide access to your existing hosting account or website files. Migrations are performed on a best-effort basis, and you remain responsible for verifying that your website works correctly after the migration is complete.

11. Payments and Billing

Services are billed annually in Indian Rupees (INR) at the rates shown on our website at the time of purchase. Payment is due at the time of order. Applicable taxes may be added to your invoice. If a payment fails, we may suspend or terminate the affected Services in accordance with these Terms.

12. Renewals

Unless you cancel before the renewal date, your Services will renew for the same billing period. Web Hosting plans renew at the same annual price paid when you purchased that plan, with no price hikes for the lifetime of the plan: ₹599/year for Starter, ₹799/year for Business, and ₹899/year for Professional. You can manage or cancel renewals from your client area. Refunds for renewals are subject to our Refund & Cancellation Policy.

13. Suspension and Termination

We may suspend or terminate your access to the Services if you breach these Terms or the Acceptable Use Policy, if payment is not received, or if required by law. You may cancel your Services at any time from your client area. Upon termination, your access to the Services and any associated data may be removed in accordance with our policies.

14. Intellectual Property

You retain all rights to the Content you store or transmit through our Services. We retain all rights to our platform, software, website, branding and related materials. Nothing in these Terms transfers any intellectual property rights to you except the limited right to use the Services.

15. Third-Party Services

Our Services may rely on or integrate with third-party services, including infrastructure, software and payment providers. We are not responsible for the availability, performance or conduct of third-party services. Your use of any third-party service may be subject to that provider's own terms.

16. Service Availability

We work to keep our Services available and reliable, but we do not guarantee uninterrupted or error-free operation. The Services are provided on an "as is" and "as available" basis. Planned maintenance may occasionally require brief periods of unavailability, and we will aim to carry out maintenance at low-traffic times where possible.

17. Limitation of Liability

To the maximum extent permitted by applicable law, TorkHost shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, business or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising out of or related to the Services shall not exceed the amounts you paid to us for the Services during the twelve (12) months preceding the claim.

18. Indemnification

You agree to indemnify and hold TorkHost harmless from and against any claims, damages, losses and expenses (including reasonable legal fees) arising out of or related to your Content, your use of the Services, or your breach of these Terms or the Acceptable Use Policy.

19. Changes to Services

We may modify, update or discontinue features of the Services from time to time. Where reasonably practicable, we will provide notice of significant changes. Continued use of the Services after a change constitutes acceptance of the updated Services.

20. Changes to Terms

We may update these Terms from time to time. The current version will always be published on this page with an updated "Last Updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

21. Governing Law

These Terms are governed by the laws of India. Any disputes arising out of or related to these Terms or the Services shall be subject to the exclusive jurisdiction of Courts in New Delhi, Delhi, India.
